'Historical sanction' to Nissui’s Chilean subsidiary for illegal fishing in Falklands
(ARGENTINA, 4/13/2016)
The Ministry of Agro-Industry has implemented the maximum fine to the fishing firm Empresas de Desarrollo Pesquero de Chile SA (Emdepes SA), a Chilean subsidiary of the Japanese group Nissui, for performing illegal fishing activities in 2014 in the exclusive economic zone of Argentina, near the Falkland Islands.
The measure is part of the Federal Fisheries Act No. 24922, and according to the national body, it is the first sanction of its kind in the history of the sector.
In a statement, the Ministry points out that the complaint was made by the citizen Juan Benegas, who mistakenly received an email in which it was stated that the Chilean flagged fishing vessel Union Sur had obtained permission from the United Kingdom to operate in the Falkland Islands, and decided to inform the relevant authorities.
"Following the complaint, made in late 2014 to the Foreign Ministry and the Undersecretariat of Fisheries and Aquaculture of the Nation, a record began in the scope of the latter, which, working jointly with the Argentine Naval Prefecture, collected the necessary documentation for the record procedure, which proved that the vessel fishing Union Sur carried out fishing activities in the area of the Falkland Islands," says the official communication.
The fishing vessel Union Sur, belonging to Emdepes SA, had sailed from Punta Arenas bound for the Falkland Islands with British fishing license.
But the Argentine legislation (Act No. 24922) establishes the prohibition to operate simultaneously in Argentine waters and have a fishing license issued by the British administration of the islands.
Argentina has been claiming sovereignty over the Malvinas Islands (Falklands for the UK) since 1833, after the "illegal occupation" of the archipelago located in the South Atlantic.
In January, sources from the Foreign Ministry and the Ministry of Agro-Industry of the Nation confirmed that the Argentine government would send an appeal to the Chilean company.
In this context, the company presented to the Argentine authorities and took responsibility for the fact, paying the fine imposed.
