Moscuzza secures hake quota for three ships

Hubbsi hake quotas have been distributed for 2020. Based on the recommendations of INIDEP and the decision of the Federal Fisheries Council, the Maximum Permissible Catch was set at 290,000 tons. Under current legislation, 69.47% of that figure must be distributed among ships that have an individual catch quota. The total to be distributed among 152 ships is 201,463 tons.

Of that volume, 3,263 tons were granted to the Stella Maris I; 2,483 tons to Don Cayetano and 2,187 tons to Itxas Lur, all vessels of the Moscuzza Group. On these ships there is a first instance ruling of the year 2018 that orders the suspension of the permits for having been obtained illegally in the nineties.

Stella Maris I, Don Cayetano and Itxas Lur obtained their catch authorizations from the ship Santa Eugenia, whose permit was declared void of absolute nullity in 2003 by the then intervener of the Fisheries Directorate, Nélida Videla, which was ratified by the General Audit of the Nation (AGN) and by the report on revision of fishing permits commissioned in those years to the University of Buenos Aires.

Based on these reports, the then Undersecretary of Fisheries ordered the suspension of the capture authorizations generated by the Santa Eugenia, repealed the resolutions that enabled it and generated injurious actions at judicial headquarters. Then Moscuzza acted against the Argentine State and finally in 2018 a first instance ruling was obtained contrary to the interests of the company.

Judge Enrique Lavié Pico ordered to declare the null permit of absolute nullity, and the same for the resolutions that allowed the transfer of the vessel, indicating that what the Undersecretary of Fisheries acted properly in 2003, having also performed an impeccable administrative Procedure.

Juan Bosch, who was Undersecretary of Fisheries until December 2019, had the decision in his hands but did not act in defense of the interests of the State but of those of the businessman. Bosch did not take any action to prevent the departure of the vessels that took their capture authorizations declared illegal by justice: Don Cayetano, Itxas Lur and Stella Maris I.

Moscuzza appealed the ruling and today the cause is in the Chamber. However, and as expressed by the judge in his ruling, the fisheries authorities are in a position to order the suspension of ships in administrative headquarters. This could be done by filing a precautionary measure that would hold the vessels moored at the docks until a final sentence is reached.

Juan Bosch left office without doing it and unfortunately nothing has done the new 'Kirchnerist' fisheries management. Not only do they continue to act in favor of a businessman with illegal fishing permits, but the interests of the Argentine State are not defended either. Both during the Macri administration and at the present time, Moscuzza continues to benefit with about 8000 tons of hubbsi hake that swell its assets illegally.

It will be interesting to see how far the current government is willing to differentiate itself. For now, they seem to be acting identically to their predecessors.
