Benegas achieved his first goal: Nissui accepted charges and paid penalty

Emdepes (Nissui Chile) finally acquiesced to the charges contained in the case brought by the complaint lodged by Juan Benegas on December 22, 2014, which has been discussed in detail in several articles published by FIS.com (see links at the bottom).

"After more than 15 months of administrative and legal procedures and continuous monitoring via national and international press reports, and Argentine government authorities, I see with extreme satisfaction that the Nissui Group accepted the charges, both in Argentina and in Chile, and paid the fine indicated by the Argentine law," Juan Benegas told FIS.com.

"So far I have focused on the country, on the Falklands (Malvinas) and on obtaining a sanction for the Nissui Group, a goal that today I deem as ended. But I remember that Nissui fired me within 24 hours, after working there for more than 26 years, for having denounced for having an illegal action, a mockery to all the Argentineans and their laws and institutions. So now I will focus on Nissui Japan and the managers who treated me in a dishonorable way," he added.

"Actually, it's a shame that Nissui manage their businesses in third countries unscrupulously and illegally. For example, what I find extremely striking -- and I must confess that it causes distress to me --, is that Mr. Seiji Takahashi, who before my complaint for fishing illegally in the Falklands was only Nissui chairperson for Latin America, after my complaint was promoted to Nissui chairperson in North America, in addition to maintaining the position he already had for Latin America."

Benegas sent FIS.com an official copy in which the Nissui Group report this officially as a result of a shareholders' meeting held on June 25, 2015.

Nissui Group chairperson received in Tokyo a personal note from me, where I explained about the crime committed and my position as to it (this was done while being an employee of the group). I also took the decision to then report back to the Japanese ambassador to Argentina with a copy to Mr. Takahashi and the Group chairperson, and the only answer I got was my immediate dismissal and the start, on their part, against the clock negotiations with Newsan Group to sell the subsidiary in Argentina with the childish idea of trying to show that Nissui had no operations in this country and therefore, it was not breaching any law. Luckily, reality has shown that this was a set and that they have had to accept the charges without questioning absolutely anything," explained Benegas. 

He continued: "I will not comment now on Nissui-Newsan agreement, but I will focus on claiming Nissui Japan managers, and informing managers of the Stock Exchange of Tokyo, everything that happened, as the conduct codes of Nissui group prohibit to act in this way and plan internal investigation mechanisms. My dismissal responded to a desperate reaction they had, exactly, as they should have analyzed the situation and sanctioned internally those who gave the order to operate illegally."

In this regard, Benegas also sent FIS.com a copy of Nissui Ethics Code, "where all this is duly explained."

"It must be clarified that regarding the Tokyo Stock Exchange, who also have very strict conduct codes and it attracts my attention that they have not sanctioned Nissui so far for committing illegal acts in other countries," he concluded.

FIS tried to move forward on their plans abroad, but it preferred to close the interview in this way in order not to advance the steps being organized by attorneys and foreign support.
